New Canaan Man’s Company Sues Heritage Hill Road Condo Association

During a secret meeting last month, the board of a condo association in New Canaan adopted overly restrictive leasing rules in a way that violates state law as well as the organization’s own governing documents, according to a new lawsuit. The Oenoke Association failed to notify owners at the 164-unit brick condo complex on Heritage Hill Road of proposed new rules as per a state law that requires such an executive board to provide at least 10 days prior to “adopting, amending or repealing any rule” and informing those owners just which day it will act, according to a lawsuit filed Oct. 11 on behalf of a New Canaan man’s company. Captain Jack LLC, whose principal is Thomas Hudson of West Road, has purchased 23 condos and 11 garages at Oenoke Condominium since the beginning of last year, according to a complaint filed in state Superior Court by attorney Ronald Barba of North Haven- based Bender Anderson and Barba P.C., a law firm whose website is CondminiumLawyers.net. Records show that the company has paid more than $6.7 million in making the acquisitions.

‘Captain Jack LLC’ To Replace Windows on Seven Heritage Hill Road Units; New Construction Planned for Devonwood Lane

Town officials on Tuesday issued seven building permits to a local man’s limited liability company that rapidly purchased 19 of the brick condominium units on Heritage Hill Road, causing concern among some owners there. The permits call for the installation of 71 vinyl replacement windows throughout seven of the Oenoke Association units, at a total cost of $58,946. Captain Jack LLC since the start of 2016 has spent more than $6.7 million acquiring 19 of the 1960s- and ‘70s-built condo units, land records show. It isn’t clear whether the units approved for building permits are to be sold. Realtors commenting on NewCanaanite.com have cautioned that if one party owns more than 10 percent of all units, the complex itself becomes unwarrantable with regard to conventional lending.

‘Concerns’ Among Homeowners as ‘Captain Jack LLC’ Now Owns More Than 10 Percent of Heritage Hill Condos

Though it remains unclear what designs, if any, a New Canaan man has on the Heritage Hill Road condominiums that he’s been buying up since early-2016 through a limited liability company, the homeowners association there appears to have taken steps to try and limit the resident’s ownership. After a flurry of purchasing activity in the past week (see table below), West Road resident Thomas Hudson—principal of Captain Jack LLC—now owns 19 of the 1960s- and ‘70s-built condo units, land records show. According to a Feb. 16 letter that the Oenoke Association sent to owners last week, the group’s Board of Directors had put forward a “Declaration Amendment to Limit Ownership” that was to have been voted on during a Feb. 21 meeting.
