The owner of a commercial building on Elm Street last week filed papers to evict a tenant there, saying rent hasn’t been paid since October, court records show.
According to a complaint filed Feb. 6 in state Superior Court, the tenant at 39 Elm St. failed to pay $11,250 that month and every month thereafter.
The address is the same as the Adirondack Store, which is listed as a non-appearing defendant in the case.
A Notice To Quit Possession was served on the tenant on Jan. 5, according to the complaint, filed on behalf of three plaintiffs by attorneys Jared Alfin and James Trudell of Simsbury-based Hassett & George P.C. They are seeking “[a] judgment for immediate possession of the premises” and forfeiture of the possession and personnel effects of the tenant, the lawsuit said.
The plaintiffs in the case are Randolph DE, LLC, Randolph GN, LLC and 39 Elm Street Associates, LLC—the managing partner of a White Plains, N.Y.-based real estate investment company is listed in Connecticut Secretary of the State records as principal of the last of those.
