Field Club Challenges Neighbor’s Property Ownership Claim

The New Canaan Field Club is disputing property rights with one of its neighbors, documents show.

The residents of 164 Smith Ridge Road, a .68-acre residential property located just north of the private club on Route 123, “have made claims of ownership and/or control through adverse possession or via an easement to a section of” the Field Club’s property, according to a Notice filed June 21 in the Town Clerk’s office by attorney Todd Lampert of New Canaan-based Lampert, Toohey & Rucci LLC. 

The club-owned property includes part of what the neighbors use as their driveway, according to Lampert. The neighbors’ “use and/or maintenance” of the disputed property “encroaches” upon the Field Club-owned lot, according to the Notice.

“The New Canaan Field Club, Inc. claims use and ownership” of the property and “disputes any rights of possession” that the neighbors claim, Lampert said in the Notice.

The club is “filing this notice to prevent them from gaining any possession rights,” it said.

“It being the intention of the New Canaan Field Club Inc. to prevent [the neighbors] or their heirs, successors and assigns from acquiring possession rights in and to the Adverse Property,” Lampert said in the Notice.
