Police on Saturday night arrested a 22-year-old Gerdes Road man and charged him with second-degree breach of peace.
He had been harassing and contacting an individual in the area of 103 Main St., Gofer Ice Cream, according to a police report. The victim contacted police about the incident, because the man had been warned following a prior incident not to have any contact with the victim, the report said.
Police found the man near 208 Elm St. and issued him a summons for the misdemeanor offense.
Under state law, a person is guilty of second-degree breach of peace if he or she “with intent to cause inconvenience, annoyance or alarm, or recklessly creating a risk thereof … [e]ngages in fighting or in violent, tumultuous or threatening behavior in a public place,” “assaults or strikes another,” “threatens to commit any crime against another person or such other person’s property,” or “publicly exhibits, distributes, posts up or advertises any offensive, indecent or abusive matter concerning any person,” among other reasons.
The man was released after promising to appear Nov. 10 in state Superior Court.
According to Connecticut Judicial Branch records, New Canaan Police had arrested the man twice, on Sept. 19 and 30, and charged him with first-degree criminal trespass in each instance. NCPD also had arrested the man in September 2021 and charged him with interfering with an officer and multiple motor vehicle-related offenses.
