New Canaan Man Files Legal Notice with Town After Tripping on Elm Street Sidewalk

An 81-year-old New Canaan man who says he tripped on a brick protruding from an Elm Street sidewalk last fall last week filed a notice that the town is liable for damages. Harvey Melzer was walking up past Elm Restaurant at around 11:54 a.m. on Oct. 15 (a Tuesday) when he “tripped and fell on a protruding brick piece of the sidewalk and fell upon his left hip, knee and hand,” according to a notice letter filed on his behalf by attorney Jason Gladstone of New Canaan-based Lampert, Williams & Toohey, LLC. He “was caused to trip and fall on a defective piece of sidewalk, which was in disrepair, unsafely protruding from the sidewalk and caused a dangerous condition,” the notice letter said. He injured his left hand, knee and hip, as well as his neck, and suffered contusions and abrasions, it said. 

“Harvey Melzer intends to hold the Town of New Canaan responsible for any and all damages, as provided by law,” it said.

New Canaan Police at 9:37 a.m. on Dec. 31 arrested a 43-year-old Bridgeport man and charged him with second-degree failure to appear. An officer using radar to conduct speed enforcement stopped him on Carter Street and found that a paperless re-arrest warrant that had been issued for the man. According to Connecticut Judicial Branch records, he had been arrested by Bridgeport Police in March 2009 on motor vehicle-related charges, including operating a motor vehicle while under suspension. ***

New Construction Planned for Brooks Road

The New Canaan Building Department on Nov 28 received an application for an approximately 5,500-square-foot home on Brooks Road. The four-bedroom house planned for 68 Brooks Road will include five full bathrooms, two half-baths, a fireplace, two-car garage and 996-square-foot finished basement (with a playroom that has a half-bath), according to the building permit application. In all, the first and second floors will include about 4,087 square feet of living space, it said. The house will cost about $1.6 million to build, the application said. The contractor on the job is New Canaan-based Gardiner and Larson Homes LLC, the architect Judith Larson Associates, LLC.

Commercial Building at Elm and Main Sells for $6 Million

A retail-and-office building in the heart of downtown New Canaan has sold for $6,025,000, according to a property transfer recorded Tuesday in the Town Clerk’s office. Tenants in the commercial building at 4 Elm St.—located on the southwest corner of Elm and Main Streets—include William Raveis Real Estate and G. Albert. The 1954-built structure includes a gross leasable area of 5,454 square feet, town tax records show. The building was sold by David Silverberg, co-trustee, to a limited liability company based in Southport, town and state records show. According to Secretary of the State records, the managing principal of BLCR Holdings, LLC is William M. Raveis Jr. 

Prior to the sale, the building had been continuously owned for at least 50 years, according to town tax records.
