Lawsuit: Downtown Building Owner Seeks To Evict Medical Services Company for Nonpayment of Rent

The owner of a commercial building on Cherry Street is suing a second-floor medical services business for nonpayment of rent, court records show.

The original 2012 lease between Cherry Street West LLC and Medical Aesthetics LLC—companies owned by New Canaan residents—started in 2012 and, after an oral extension, expired in the fall of 2017, according to a revised complaint filed Dec. 23 in state Superior Court.

Yet the tenant at 156 Cherry St. failed to pay rent and on Sept. 2020, the plaintiff moved to evict the company, according to the complaint, filed on behalf of the property owner by attorneys Michael Jones and Sean Hamill of Greenwich-based Ivey, Barnum & O’Mara.

The company continues to occupy the building and the “plaintiff has been damaged thereby,” according to the suit.

The complaint seeks to evict the tenant, “forfeiture of the possessions and personal effects of defendant” under state law, and “such other further and different relief as this court may deem equitable.”

The defendant is represented by Stamford-based Mark Sank & Associates LLC. The original complaint had been filed Oct. 30, according to Connecticut Judicial Branch records. 

The plaintiff’s attorneys twice have filed motions for judgement for possession for failure to plead.
