Police on New Year’s Day arrested a 57-year-old Park Street woman and charged her with third-degree criminal mischief, third-degree assault and disorderly conduct.
At about 7:45 p.m. on Jan. 1, officers responded to her Park Street home on a reported dispute between the woman and a victim.
Through an investigation, the officers established probable cause to arrest the woman on the misdemeanor charges, according to a police report.
It isn’t clear how the woman assaulted the victim, what property she damaged or what caused the dispute. Police withheld details, saying it was a domestic incident.
Under state law, a person is guilty of third-degree criminal mischief if he or she “having no reasonable ground to believe that such person has a right to do so, such person: (1) Intentionally or recklessly (A) damages tangible property of another, or (B) tampers with tangible property of another and thereby causes such property to be placed in danger of damage; or (2) damages tangible property of another by negligence involving the use of any potentially harmful or destructive force or substance, including, but not limited to, fire, explosives, flood, avalanche, collapse of building, poison gas or radioactive material,” among other reasons.
A person is guilty of third-degree assault, according to state law, when “with intent to cause physical injury to another person, he causes such injury to such person or to a third person” or “recklessly causes serious physical injury to another person or “with criminal negligence, he causes physical injury to another person by means of a deadly weapon, a dangerous instrument or an electronic defense weapon,” among other reasons.
Police released the woman after she promised to appear the next day in state Superior Court.
