Police: Reckless Endangerment, Assault Charges for New Canaan Man, 49

Police after midnight Wednesday arrested a 49-year-old New Canaan man and charged him with first-degree reckless endangerment, third-degree assault and disorderly conduct.

At about 11:18 p.m. on April 30, officers were dispatched to a Toby’s Lane home on a report of domestic disturbance between occupants of the residence, police said.

There, officers conducted an investigation that resulted in the man being charged at 1:36 a.m. Wednesday with the three misdemeanor offenses. 

It wasn’t clear what the disturbance involved, whether or how the arrested man is related to the victim, in what way it was physical, what types of injuries the victim sustained or in what way the man endangered that individual. 

Under state law, a person is guilty of first-degree reckless endangerment in the first degree “when, with extreme indifference to human life, he recklessly engages in conduct which creates a risk of serious physical injury to another person.”

Under state law, a person is guilty of disorderly conduct when, with intent to cause inconvenience, annoyance or alarm, engages in fighting or in violent, tumultuous or threatening behavior; or by offensive or disorderly conduct, annoys or interferes with another person, among other reasons.

A person is guilty of third-degree assault, according to state law, when “with intent to cause physical injury to another person, he causes such injury to such person or to a third person” or “recklessly causes serious physical injury to another person or “with criminal negligence, he causes physical injury to another person by means of a deadly weapon, a dangerous instrument or an electronic defense weapon.”

He was held on $5,000 bond and scheduled to appear Wednesday in state Superior Court in Norwalk.
