New Canaan Landlord Arrested After Turning Off Heat, Electricity in Garibaldi Lane Apartment

Police arrested a 63-year-old New Canaan man by warrant last week and charged him with violating a state law that requires heating and provision of utilities for buildings.

On Jan. 21, police received a complaint about a landlord turning of utilities at a Garibaldi Lane residence, officials said.

The complainant said that heat and electricity no longer worked at an apartment in the residence, according to a police report.

Following an investigation, police determined that the local man had been responsible for shutting off the utilities, the report said. Police obtained a warrant for his arrest on the misdemeanor charge, it said.

Under state law, landlords must keep residential dwellings, minimally, at 65 degrees, and must furnish heat and electricity, among other utilities.

The man turned himself in at a bout 2:35 p.m. on March 10. He was released after promising to appear March 31 in state Superior Court.

According to Connecticut Judicial Branch records, the man on Feb. 10 filed eviction papers for a tenant at the Garibaldi Lane home, saying the lease there had expired Jan. 31 and she hadn’t paid rent for at least four months.
