Police: Breach of Peace Charge for Former Downtown Worker

Police last week arrested a 26-year-old Fairfield man for the second time this month.

At about 8:48 a.m. on Jan. 15, officers were dispatched to a Main Street business on a report of a worker approached by a former employee, according to police. The former employee had been charged Jan. 7 with criminal trespass and, as a result, was ordered to stay away from the establishment, according to a police report.

The arrest took place at 130 Main St., the report said—the building that houses Spiga restaurant. 

He was charged with second-degree breach of peace and violation of conditions of release.

Under state law, a person is guilty of second-degree breach of peace if he or she “with intent to cause inconvenience… (1) Engages in fighting or in violent, tumultuous or threatening behavior in a public place; or (2) assaults or strikes another; or (3) threatens to commit any crime against another person or such other person’s property; or (4) publicly exhibits, distributes, posts up or advertises any offensive, indecent or abusive matter concerning any person,” among other reasons.

Police transported the man to headquarters for processing. He was held on $25,000 bond and scheduled to appear the following day (Jan. 16) in state Superior Court.

According to Connecticut Judicial Branch records, the man also was arrested Jan. 8 by Wilton Police and charged with first-degree criminal trespass and second-degree breach of peace, both misdemeanors.

The man has not yet pleaded and now is scheduled for arraignment March 11 on all charges, court records show. He is being held in custody, the records show.
